Retirewise Terms of Service

1) Acceptance of Terms

These Terms of Service ('Terms') govern your access to and use of Retirewise's websites, mobile apps, tools, APIs, content, and services (collectively, the 'Services'). By creating an account, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy and Cookie & Tracking Technologies Policy (together, the 'Policies'). If you do not agree, do not use the Services.

2) Eligibility & Territory

You must be at least 18 years old to use the Services. The Services are designed primarily for Canadian residents; some features may be unavailable outside Canada. You are responsible for compliance with local laws where you use the Services.

3) Description of Services (Informational Only)

Retirewise provides AI-enabled retirement planning tools (e.g., calculators, financial projections, expense tracking, educational content, and personalized recommendations). The Services are for general information and education only and do not constitute financial, investment, tax, accounting, or legal advice.

4) Account Registration & Security

You may need an account to access certain features. You agree to provide accurate, current, and complete information; maintain the confidentiality of your credentials; and promptly notify us of any unauthorized use. You are responsible for all activities under your account.

5) User Responsibilities (Acceptable Use)

You agree not to use the Services for unlawful purposes; not to attempt unauthorized access; not to introduce malware; not to disrupt the Service; not to use automated scraping tools without consent; not to impersonate others; and not to upload unlawful content.

6) Subscriptions, Trials, Fees & Taxes (if applicable)

Some features may require a paid subscription. Subscriptions may auto-renew unless cancelled before renewal. Fees are non-refundable except as required by law. Taxes may apply. Payments are processed by third-party providers.

7) Financial Content, Projections & Risk Disclosures

Outputs and projections depend on assumptions and user-provided data. We do not guarantee accuracy or outcomes. You are solely responsible for financial decisions made using the Services.

8) AI & Automated Functionality

The Services may include AI-based features. Outputs may be incomplete, inaccurate, or biased. You must review outputs before relying on them. No fiduciary duty arises from AI features.

9) Third-Party Services, Links & Data Sources

The Services may link to or integrate with third-party providers. We do not control or endorse them and are not responsible for their practices. Use may be subject to third-party terms.

10) Intellectual Property; License to Use

All software, content, and trademarks belong to Retirewise or its licensors. You are granted a limited, non-transferable license to use the Services for personal, non-commercial purposes. Unauthorized use may result in termination and legal action.

11) User Content & Feedback

You grant Retirewise a license to host, process, and display your content solely to provide the Services. Aggregated/anonymized data may be used for analytics. Feedback provided may be used without restriction or compensation.

12) Confidentiality

Retirewise will treat non-public information you provide as confidential unless it is already public, independently developed, or disclosed lawfully by a third party.

13) Privacy & Cookies

Your use of the Services is subject to our Privacy Policy and Cookie & Tracking Technologies Policy.

14) Security

We implement safeguards to protect your data, but no system is completely secure. You are responsible for your devices and credentials.

15) Beta Features & Pre-Release Software

Beta features are provided 'AS IS' with no warranties and may be discontinued at any time.

16) Availability, Maintenance & Modifications

We may add, change, or remove features, conduct maintenance, or discontinue parts of the Services at any time.

17) Warranty Disclaimers

The Services are provided 'AS IS' and 'AS AVAILABLE.' We disclaim all warranties to the fullest extent permitted by law.

18) Limitation of Liability

Retirewise is not liable for indirect, incidental, consequential, or punitive damages. Our liability shall not exceed CAD $100 or the fees you paid in the past 12 months, whichever is greater.

19) Indemnification

You agree to defend, indemnify, and hold harmless Retirewise and its affiliates from claims, damages, or expenses arising from your use of the Services or violation of these Terms.

20) Export Controls & Sanctions

You agree to comply with applicable export control and sanctions laws. You may not use the Services if subject to sanctions.

21) Governing Law & Jurisdiction

These Terms are governed by the laws of Ontario and Canada. Disputes shall be subject to the exclusive jurisdiction of Ontario courts.

22) Class Action Waiver; Jury Trial Waiver

To the extent permitted by law, you waive participation in class actions and jury trials for disputes relating to these Terms.

23) Suspension & Termination

We may suspend or terminate your access for breach of these Terms. Certain obligations, including IP, confidentiality, and indemnity, survive termination.

24) Changes to These Terms

We may update these Terms. Material changes will be communicated in advance where required. Continued use after updates constitutes acceptance.

25) Miscellaneous

These Terms and Policies are the entire agreement. If any provision is invalid, others remain in effect. We may assign our rights; you may not without consent.
